Dear All,
I have applied for L1 B extension and the Status is Pending Petition Filing with my Company. My visa Expires by Dec 14th 2009 and i have to travel back to India by Dec 18th 2009 immediately due to personal emergency.
I dont have any acknowledgement till date for the extension as it is under process.
Following are my question
1) Will i have any issues when i return to india after 4 days of my visa expiration?Will it anyway affect my future visa petitions?
2) If the extension is filed, Is there any chances for the extension getting approved even if am not here unless there is no RFE.
Your answers would greatly help me. Thanks

American lawmakers have created a law that needs only top talent. By law it go from top to bottom. So they go from EB1, EB2, EB3 and so on. If we disagree, then get the law changed.
EB3 I is screwed big time and they are ignorant about this .EB3 are responsible for their own loss. I see them tracking LUDs and laugh at their ignorance of wasting their time.
They should be doing hunger strikes and do a rally in DC every month.
Else they can forget Green card coming any time soon.

If the attorneys have determined that there needs to be a INA change to allow I-485 filing during retrogression, has anybody bothered to find out what USCIS interpretation is?

Ash, I agree with the message but you need to work on the choice of words. This not ethnic cleansing or lynching or systematic targetting. I'd say America is going into a protectionist mode. When you are in that mode, the first step is to keep aliens at a distance.

Every alien, eighteen years of age and over, shall at all times carry with him and have in his personal possession any certificate of alien registration or alien registration receipt card issued to him pursuant to subsection (d) of this section. Any alien who fails to comply with the provisions of this subsection shall be guilty of a misdemeanor and shall upon conviction for each offense be fined not to exceed $100 or be imprisoned not more than thirty days, or both.
So at least make a copy of your I-94/approval notice/GC and keep it in your wallet.
By law, you are not suppose to make copies of an official US document.
Also, a police officer cannot deport you. He will most likely make a call to the nearest border security post and can either chose to hand you over to them or check your status over radio/phone.
Rule of thumb for all immigrants is to make sure you carry your documents when traveling withing 100 miles of the US border.
If you are a student, some cops will also let you go if you show your student ID combined with your State Issued ID.
For those states that required for you to prove your valid immigration status when applying for a state ID, a gentle plea to the cop that the state couldn't have issued your ID unless they verify your status, might work!

That's bull. Online at top-rated university costs as much as full-time but definitely not more. Most of the top-notch universities don't even differentiate in-state and out-of-state. M.B.A is a money printing machine for them. Assistantships, in full-time schools, are very few and scarce and competition for them is pretty high. I have friends going to Darden School of Business as full-time students and they are paying close to $70k in fee alone. Add to this the cost of living, books etc. Times are pretty bad now and few of them couldnot even get internships for this summer and few who got had had their offers rescinded. For full-time school you have to consider something called "Opportunity Cost". There was a article in Businessweek which mentioned that a Harvard full-time M.B.A will take 15 years to break-even on his M.B.A investment. The reason for this is that he will be spending $80k on fee alone, another $20-30k for living expenses for 2 years, another 10-20k in books and other expenses. At the same time he would have lost on a average $160-200k in 2 year salary and benefits. Combines together it adds upto $300k which can be invested at average 6% interest, if you are a savvy investor, and get good returns. Assuming a Harvard M.B.A graduate on a average make $120k out-of-school if would take 15 years for him to break-even even with all the increments and bonuses.
Dont take current year as a standard (unless you believe that things will get only worse from here). About your ROI description, it is very generic. Each person has to take his or her personal circumstances into consideration before making this calculation. It is my feeling that "Illegals>5 years" should not be preferred over "legals<5 years".
really? so you mean illegals are not humans? Or just because you are not in the category, you think only you deserve to live a "respectable" "decent" life, and others should wait in line until you are satisfied. That way of looking at things is exactly the way Citizens look at green cards, people will green card look at non-green holders, people with H1/L1 look at illegals. And that behavior or way of looking at others can described in one phrase - "I'm better than you." And when rules are changed, and we can no longer subscribe t that "false" notion of "I'm better than you.", you think there is something wrong with the bill.
What is wrong with the bill that gives everything that you want, and in addition to it, gives that "illegal alien" what he deserves, not on the grounds of a degree, which is merely a piece of paper, but on the grounds of how humans ought to treat other humans? Thanks for good wishes and congratulations to all who become current.
Regarding cutoff date I'm hearing multiple theories -
A. if it says 1st March - then prior to that consider as active - 1st of March is not included
B. some says 1st March is included because it is like UNTIL 1st March
C. Someone told me if cutoff date fall on weekend then consider that date in. 1st March in 2006 was Wednesday - just FYI.
D. someone also told me if it falls during weekdays then consider whole week - until Friday. USCIS taking cases for whole week for processing.
Wow so many options looks like I need to poll this and then wait until next bulletin :)

Interesting thing (not in a good way) to note is most EB3 India (even whose priority dates are as back as 2003-2002) have filed in June/July.
Reason: All of us(between 2002-4) were rotting in BEC for years...BEC just
vomited us out between Jan 2007 to September 07.

I'm getting confused on the date part after reading various posts.
Is it mandatory to wait for 180 days after I140 to port your PD from an old I140 to a new I140(with a different company) ?
To change jobs and continue the same GC process I believe one has to complete at-least 1180 days in I485 stage. However in this stage the new job title and responsibilities should be same
I guess Employer cannot revoke I-140 after 180 days - You may want to check with Immigration Specialist/lawyer

Guys,
After responding to the RFE last week, I have been seeing continous LUDs on my 485. They were on 10/8, 10/9 and today on columbus day 10/11. There was also one when they registered my RFE response on 10/6.
And to add to that I received a FP notice for both spouse and myself but the date isn't until after 3 weeks. Can I get the FP done early? I don't want them to sit on my application for another 3 weeks just because they are waiting for my FP.

I agree that preadjudication could be happening now and the flood gates are to be opened for Eb2 I soon. Otherwise why would USCIS work on apps and send for RFE etc?
